The Website is operated under the public brand LIFEGUARD. References to “LIFEGUARD”, “we”, “us” or “our” in this Legal Notice refer to the legal entity identified in Section 2 below and, where appropriate, to authorised entities, advisers or specialist providers acting within The LIFEGUARD Organisation.
The Website is intended to provide general information concerning LIFEGUARD, its areas of capability, professional standards, selected appointments and available means of contact. It is not intended to provide legal, financial, tax, regulatory, security, intelligence, investigative, medical, employment or other professional advice.

LIFEGUARD reserves the right to decline, limit, suspend or withdraw from any proposed engagement, appointment, discussion or communication, subject to applicable law.
5. No Emergency, Protective or Operational Response Through the Website
The Website, its published email addresses and any ordinary communication channel referenced on it are not emergency-response, crisis-response, law-enforcement, medical, rescue, protective or operational-command channels.

LIFEGUARD seeks to ensure that information published on the Website is accurate, current and presented in a professional manner. However, the Website is provided on an “as available” basis.
To the fullest extent permitted by applicable law, LIFEGUARD makes no representation or warranty, express or implied, that:

- the availability, suitability, legality, accuracy or completeness of any external information or linked resource.
This limitation applies whether the relevant claim arises in contract, tort, negligence, statutory duty, misrepresentation, restitution or otherwise.
Nothing in this Legal Notice excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.

Access to the Website does not grant any licence, assignment, ownership interest, right of use or other entitlement in relation to LIFEGUARD intellectual property, except for the limited right to access and view the Website for lawful personal or internal business purposes
10. Protection of the LIFEGUARD Name, Brand and Commercial Identity
The name LIFEGUARD, the designation The LIFEGUARD Organisation, the LIFEGUARD logo, related visual identifiers, distinctive brand elements, domain names and associated commercial signs are used by LIFEGUARD as part of its professional and commercial identity.
LIFEGUARD reserves all rights that may arise from the use, reputation, goodwill, distinctiveness and commercial recognition of those identifiers under applicable law.
Depending on the relevant jurisdiction and circumstances, such protection may arise through rights relating to commercial signs, business names, company names, goodwill, copyright, design, unfair competition, passing off, misrepresentation, domain names or other applicable legal principles.
No part of this Legal Notice should be interpreted as granting any person permission to use the LIFEGUARD name, logo, brand identity, visual language, domain names or other distinctive identifiers.
11. Unauthorised Use of LIFEGUARD Brand Elements
Without LIFEGUARD’s prior written permission, you must not:
- use the LIFEGUARD name, logo or any confusingly similar sign as a company name, business name, trading name, domain name, social-media identifier, email address or advertising keyword;
- register, acquire, use or attempt to use any domain name, social-media account, company name or identifier incorporating or confusingly similar to LIFEGUARD;
- use LIFEGUARD identifiers in a manner that suggests affiliation, endorsement, sponsorship, approval or authorisation;
- use LIFEGUARD identifiers in connection with products, services, activities or content not authorised by LIFEGUARD;
- alter, distort, recolour, combine, animate, reproduce or adapt LIFEGUARD logos or visual identifiers;
- remove or obscure copyright notices, proprietary legends or other rights notices;
- use LIFEGUARD identifiers in a defamatory, misleading, deceptive, unlawful or inappropriate manner.
LIFEGUARD reserves the right to take appropriate legal, administrative, domain-name, platform, registry, injunctive or other action against actual or suspected infringement, impersonation, passing off, cybersquatting, unfair competition, misrepresentation or unauthorised use.
12. Limited Permitted Use of Website Content
You may view, print or download limited extracts of Website content only for lawful personal, internal business or non-commercial informational purposes, provided that:
- all copyright, proprietary and source notices remain intact;
- the content is not altered, misrepresented, republished or presented out of context;
- the use does not suggest LIFEGUARD’s endorsement, association or approval;
- the material is not used for commercial exploitation, competitive intelligence, benchmarking, training, promotion or resale;
- the material is not copied, indexed, scraped, harvested, mined or extracted at scale;

13. Prohibited Website Use
You must not use the Website in a manner that is unlawful, harmful, deceptive, disruptive or inconsistent with this Legal Notice.
In particular, you must not:
- attempt to gain unauthorised access to the Website, its systems, accounts, servers, infrastructure or data;
- interfere with, disrupt, overload, damage or impair the Website or related systems;
- introduce malware, viruses, malicious code, harmful files or other disruptive technology;
- use automated means, bots, crawlers, scrapers, spiders, scripts, agents or similar tools to access, monitor, copy, harvest or extract Website content without written permission;
- perform unauthorised vulnerability scanning, penetration testing, security testing or other technical probing;

LIFEGUARD may investigate suspected misuse and may take appropriate technical, legal or administrative action, including restricting access, preserving records, reporting suspected unlawful activity and pursuing available remedies.
14. Reservation of Rights for Text and Data Mining
To the fullest extent permitted by applicable law, LIFEGUARD expressly reserves all rights in relation to the reproduction, extraction, scraping, indexing, harvesting, mining, analysis, copying, storage, aggregation and use of Website content for text and data mining.
This reservation applies in particular to the use of Website content for:
- artificial-intelligence and machine-learning training;
- large-language-model development, training, evaluation or fine-tuning;
- automated content generation;
- commercial data aggregation;
- competitive intelligence;
- database creation;
- automated profiling;
- surveillance or monitoring systems;
- search-engine or information-retrieval systems other than standard indexing expressly authorised by LIFEGUARD.
This reservation applies in addition to any technical restrictions, robots directives, machine-readable metadata, access controls, contractual restrictions and applicable statutory protections.
Nothing in this section is intended to restrict uses that cannot lawfully be restricted under mandatory law.
15. Copyright Notices and Third-Party Rights

Information concerning cookies, similar technologies and preference-management mechanisms is set out in the Cookie Notice, where applicable.
By contacting LIFEGUARD through ordinary email or other unencrypted means, you acknowledge that such channels may not be suitable for highly sensitive, classified, legally privileged, security-restricted or commercially confidential information.
LIFEGUARD may ask you to use a secure communication channel before discussing or receiving sensitive information.
18. Applicable Law and Jurisdiction
This Legal Notice and any non-contractual obligations arising out of or in connection with it shall be governed by the laws of Switzerland, Malta, Austria, the EU, and the UK excluding its conflict-of-law rules, except where mandatory law requires otherwise.
The courts of Valletta, Malta, and Vienna, Austria shall have exclusive jurisdiction over disputes arising out of or in connection with this Legal Notice, except where mandatory consumer-protection, employment, data-protection, procedural or other laws provide otherwise.
Nothing in this clause is intended to deprive an individual of rights that cannot lawfully be excluded, restricted or waived under applicable law.
For users located in the European Economic Area, Switzerland, the United Kingdom or other jurisdictions with mandatory local protections, applicable mandatory law may provide additional rights or remedies.

If any provision of this Legal Notice is held to be invalid, unlawful, unenforceable or ineffective in whole or in part, that provision shall be interpreted, modified or limited to the minimum extent necessary to make it valid and enforceable.
The validity and enforceability of the remaining provisions shall not be affected.
